The guard is an observation channel in the controller. The example violates ass:sched, not thm:spectators. Repartitioning, queue priority, timing, or a spectator-readable transport history can produce the same failure.
The spectator theorem does not apply if geometry, coupling, control, or certification reads spectator cardinality, spectator state, or spectator-dependent resource availability through an undeclared input.
